Introduction
Bernard regularly advises clients on a wide variety of employment matters including: whistleblower claims; discrimination, harassment, and retaliation based on race, sex, religion, national origin, age, and disability; wage payment and Fair Labor Standards Act compliance; OSHA compliance; covenants not to compete and trade secret protection; and leave/FMLA related matters. He regularly conducts workplace whistleblower, safety, and discrimination/harassment/retaliation investigations. He has experience with multiple industries including advising health care providers on contractual and other related matters, and manufacturing, technology, and service companies.
Bernard has represented employers in matters before multiple state and federal trial and appellate courts, and administrative agencies including state and federal Departments of Labor, Occupational Safety and Health Review Commissions, and Equal Employment Opportunity Commissions. Bernard also has experience in defending FAA Air21 whistleblower claims before the US DOL, Longshore and Harbor Workers Act claims before the US DOL’s Office of Workers’ Compensation Programs, and workers’ compensation claims before various states’ agencies.
Bernard lives in Matthews, NC, with his wife, Kathy, three children, and three dogs.
